General terms and conditions
Article 1 – Preamble
1.1. Vendor identity
The services described in these general terms and conditions are offered by SARL 3V, trading under the brand name Kayak Vert Pont du Gard.

Hereinafter referred to as "the Operator".
1.2. Purpose
These general terms and conditions define the rights and obligations applicable to the rental of water sports equipment and associated services offered by the Operator.
1.3. Definitions
- Customer: any natural or legal person entering into a contract with the Operator.
- Participant: any person taking part in the service.
- Group: a single booking covering 10 participants or more.
- Service: rental of water sports equipment and associated services.
- Online contract: contract concluded via the website www.kayakvert.com.
- Distance contract: contract concluded by telephone or email.
Article 2 – Scope of application
These general terms and conditions apply to all services offered by the Operator, regardless of the sales channel used. Any booking constitutes full and unconditional acceptance of these terms and conditions.
Article 3 – Pre-contractual information
The Customer acknowledges having received, prior to the conclusion of the contract, all information required by the French Consumer Code.
Article 4 – Pricing and payment terms
4.1. Pricing
All prices are quoted in euros inclusive of tax. They include the items stated in the quote, booking, or service description. Group rates may be offered as a flat fee.
4.2. Payment
- A 30% deposit is generally required at the time of booking.
- The balance is due upon completion of the service, unless otherwise stated.
- For any booking made less than 30 days in advance, the Operator may require full payment upfront.
- The Operator reserves the right to suspend the service in the event of non-payment.
- Online payments are secured.
Article 5 – Equipment provided
The equipment provided includes in particular:
- Canoe(s) or kayak(s)
- Buoyancy aids (life jackets)
- One paddle per person
- One waterproof container per vessel
The equipment remains the property of the Operator throughout the duration of the service.
Article 6 – Security deposit
A security deposit may be required. It may be retained in the event of loss or damage to the equipment, without precluding additional compensation.
Article 7 – Use of equipment
The Customer is responsible for the equipment from the moment it is handed over until it is returned. In the event of loss or damage, the following indicative rates apply:

Article 8 – Customer obligations
The Customer undertakes, on behalf of themselves and all registered participants, to:
- ensure that every participant can swim 25 metres and submerge themselves,
- wear a life jacket and closed-toe shoes,
- return the equipment in good condition,
- hold valid personal liability insurance,
- not take out on the water any child under 6 years of age,
- comply with the safety instructions given by the Operator's team,
- not participate under the influence of alcohol, drugs, or any substance impairing judgement,
- not enter private properties,
- not leave equipment or waste along the route.
Article 9 – Image rights
The Customer authorises the Operator to use, for a period of ten years and free of charge, images taken during the service, without commercial exploitation or infringement of privacy.

The final number of participants must be communicated no later than 3 days before the service date.
Article 11 – No right of withdrawal
In accordance with articles L.221‑28 and L.221‑2 of the French Consumer Code, dated services are not subject to a right of withdrawal.
Article 12 – Safety
- Minors must be accompanied by a responsible adult.
- These services are not recommended for pregnant women.
- Participants must be physically and medically fit.
- Persons requiring medical treatment must bring their own medical supplies.
- The Operator may refuse or exclude any participant whose behaviour is dangerous or inappropriate, without refund.
Article 13 – Liability
- The Operator holds professional public liability insurance.
- Each participant must hold valid personal liability insurance.
- For unguided rentals, participants navigate at their own risk.
- The Operator is not liable for items lost, wet, or stolen.
- The waterproofing of containers is not guaranteed.
- External service providers remain solely responsible for their own services.
Article 14 – Contract modifications
Any modification must be accepted in writing by the Operator. Additional charges may apply. For groups:
- If the actual number is lower than the confirmed number → the confirmed number will be invoiced.
- If the actual number is higher → the Operator may refuse the additional participants.
Article 15 – Cancellation
15.1. By the Customer
Individual customers

15.2. By the Operator
If the Operator is unable to provide the service (safety, weather, force majeure), a reschedule or full refund will be offered.
Article 16 – Personal data
Data collected is necessary for managing bookings and delivering services. It is retained in accordance with applicable regulations. The Customer has the right to access, rectify, and object to the processing of their personal data.

Complaints may be filed with the CNIL (French data protection authority).
Article 17 – Insurance
The Operator holds professional public liability insurance. The Customer must hold valid personal liability insurance.
Article 18 – Disputes

These general terms and conditions are governed by French law.
